{"id":2118,"date":"2019-11-28T22:31:05","date_gmt":"2019-11-28T20:31:05","guid":{"rendered":"https:\/\/collectif-oxygene.fr\/?p=2118"},"modified":"2019-11-28T22:43:43","modified_gmt":"2019-11-28T20:43:43","slug":"oxylane-et-le-scot-du-pic-saint-loup-les-incoherences","status":"publish","type":"post","link":"https:\/\/collectif-oxygene.fr\/?p=2118","title":{"rendered":"Oxylane et le SCOT du Pic Saint-Loup : les incoh\u00e9rences"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\">L\u2019enqu\u00eate publique sur le projet de SCOT Pic Saint-Loup Haute Vall\u00e9e de l\u2019H\u00e9rault qui s\u2019est d\u00e9roul\u00e9e <\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\">du 17 septembre au 19 octobre 2018 a vu un nombre exceptionnellement \u00e9lev\u00e9 de contributions exprimer une opposition r\u00e9solue et tr\u00e8s argument\u00e9e au maintien du projet Oxylane dans <\/span><\/span> <span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\">ce document d\u2019urbanisme. Ces oppositions faisaient suite \u00e0 la demande du Pr\u00e9fet de l\u2019H\u00e9rault de retirer ce projet commercial, exprim\u00e9e dans l\u2019avis de synth\u00e8se des services de l\u2019\u00c9tat. Mais en d\u00e9pit de ces oppositions, la commission d\u2019Enqu\u00eate publique a estim\u00e9 \u00ab<\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\"><i>\u00a0l\u00e9gitime le maintien du projet Oxylane dans le projet de SCoT<\/i><\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\">\u00a0\u00bb. <\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\"><b>Elle a toutefois nuanc\u00e9 ses propos en \u00e9mettant une recommandation \u00ab\u00a0<\/b><\/span><\/span><strong><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\"><i><b>pour demander \u00e0 la CCGPSL de pr\u00e9voir, <\/b><\/i><\/span><\/span><\/strong><strong><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\"><i><u><b>en cas d\u2019annulation des autorisations accord\u00e9es au projet Oxylane<\/b><\/u><\/i><\/span><\/span><\/strong><strong><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\"><i><b>, que le SCoT soit modifi\u00e9, afin de <\/b><\/i><\/span><\/span><\/strong><strong><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\"><i><b>classer les terrains concern\u00e9s en zone strictement prot\u00e9g\u00e9e, <\/b><\/i><\/span><\/span><\/span><\/strong><strong><span style=\"color: #0000ff;\"><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\"><i><b>en pleine coh\u00e9rence avec ses objectifs.\u00a0\u00bb<\/b><\/i><\/span><\/span><\/span><\/strong><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\"> (voir <\/span><\/span><a class=\"western\" href=\"https:\/\/collectif-oxygene.fr\/?p=1726#more-1726\">notre article du 29 novembre 2018<\/a> <span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\">). <\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\"><b>Ce faisant, la Commission d\u2019Enqu\u00eate a reconnu <span style=\"text-decoration: underline;\">l\u2019incoh\u00e9rence<\/span> existant entre les objectifs du SCOT et le projet Oxylane.<\/b><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\">Le <\/span><span lang=\"fr-FR\">8 janvier 2019, les \u00e9lus de la Communaut\u00e9 de Communes du Grand Pic Saint-Loup ont approuv\u00e9 le projet de SCOT, avec le maintien du projet Oxylane. Le Pr\u00e9fet, n\u2019a<\/span><span lang=\"fr-FR\">yant<\/span><span lang=\"fr-FR\"> pas formul\u00e9 de remarques dans les <\/span><span lang=\"fr-FR\">d<\/span><span lang=\"fr-FR\">eux mois qui ont suivi,<strong> le SCOT est dev<\/strong><\/span><strong><span lang=\"fr-FR\">e<\/span><\/strong><span lang=\"fr-FR\"><strong>nu ex\u00e9cutoire le 9 mars 2019<\/strong>.<\/span><\/span><\/p>\n<p align=\"center\"><span style=\"color: #ff0000; font-size: 14pt;\"><span style=\"font-family: Times New Roman, serif;\"><b>Ce document d\u2019urbanisme est-il pour autant d\u00e9finitivement \u00e9tabli\u00a0?<\/b><\/span><\/span><!--more--><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\"><b>Notre r\u00e9ponse est NON\u00a0!<\/b><\/span><span lang=\"fr-FR\"> Et ceci, non pas pour des motifs purement \u00ab\u00a0incantatoires\u00a0\u00bb, mais du fait que nous avons d\u00e9pos\u00e9 un recours en annulation partielle de la d\u00e9lib\u00e9ration d\u2019approbation du SCOT. Recours <\/span><span lang=\"fr-FR\">gracieux<\/span><span lang=\"fr-FR\">, d\u2019abord, puis, devant le rejet de ce recours par le Pr\u00e9sident de la CCGPSL, <\/span><span lang=\"fr-FR\"><b>recours contentieux d\u00e9pos\u00e9 dans les d\u00e9lais le 10 juin 2019 aupr\u00e8s du Tribunal Administratif de Montpellier.<\/b><\/span><\/span><\/p>\n<p align=\"center\"><span style=\"color: #ff0000; font-size: 14pt;\"><span style=\"font-family: Times New Roman, serif;\"><b>Quel est l\u2019objet de ce recours\u00a0? <\/b><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: Times New Roman, serif;\"><span lang=\"fr-FR\">Pr\u00e9cis\u00e9ment, notre requ\u00eate (port\u00e9e par l\u2019association agr\u00e9\u00e9e SOS Lez Environnement) demande au Tribunal<\/span><\/span><span lang=\"fr-FR\"> \u00ab\u00a0<\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><b>de <\/b><\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><u><b>d<\/b><\/u><\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><u><b>\u00e9clarer ill\u00e9gale<\/b><\/u><\/span><\/span><\/span><\/span> <span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><b>la d\u00e9lib\u00e9ration du Conseil de Communaut\u00e9 du grand Pic Saint-Loup du 8 janvier 2019 portant approbation du SCOT Pic Saint-Loup Haute Vall\u00e9e de l\u2019H\u00e9rault\u00a0 dans ses dispositions relatives au maintien du SIP<a class=\"sdfootnoteanc\" href=\"#sdfootnote1sym\" name=\"sdfootnote1anc\"><sup>1<\/sup><\/a> Oxylane\u00a0 et <\/b><\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><b>d<\/b><\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><u><b>\u2019annuler<\/b><\/u><\/span><\/span><\/span><\/span> <span style=\"color: #000000; font-size: 12pt;\"><span style=\"font-family: Calibri, sans-serif;\"><span lang=\"fr-FR\"><b>en cons\u00e9quence <\/b><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><b>la d\u00e9cision du 26 mars 2019 rejetant le recours gracieux\u00a0\u00bb.<\/b><\/span><\/span><\/span><\/span><\/p>\n<p align=\"center\"><span style=\"color: #ff0000; font-size: 14pt;\"><span style=\"font-family: Times New Roman, serif;\"><b>Sur quels moyens nous appuyons nous\u00a0? <\/b><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">Notre argumentation pointe, en fait,<strong> les <\/strong><\/span><\/span><\/span><strong><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">contradictions<\/span><\/span><\/span><\/strong><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"> relev\u00e9es entre <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">trois des quatre<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"> objectifs du SCOT et l<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">a localisation du site d\u2019implantation<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"> du projet Oxylane, <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">\u00e0 savoir le domaine des Fontanelles \u00e0 Saint-Cl\u00e9ment-de-Rivi\u00e8re. <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">La d\u00e9cision attaqu\u00e9e est donc entach\u00e9e d\u2019erreur manifeste d\u2019appr\u00e9ciation et m\u00e9conna\u00eet <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">plusieurs articles du code de l\u2019Urbanisme, en particulier <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"> l\u2019article L.141-5 <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">qui <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">indique, en substance, que le Document d\u2019Orientation et d\u2019Objectifs (DOO), pi\u00e8ce ma\u00eetresse du SCOT, \u00ab\u00a0<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i><b>assure la coh\u00e9rence d&rsquo;ensemble des orientations arr\u00eat\u00e9es dans ces diff\u00e9rents domaines.<\/b><\/i><\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i>\u00a0\u00bb <\/i><\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">(en l\u2019<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">esp\u00e8ce\u00a0: <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"> l\u2019organisation de l\u2019espace, le d\u00e9veloppement \u00e9quilibr\u00e9 dans l&rsquo;espace rural entre l&rsquo;habitat, l&rsquo;activit\u00e9 \u00e9conomique et artisanale, et la pr\u00e9servation des sites naturels, agricoles et forestiers).<\/span><\/span><\/span> <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: Times New Roman, serif;\"><b><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">En r\u00e9sum\u00e9, <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">voici les principales <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">contradictions <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">relev\u00e9es <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">avec les objectifs n\u00b01, n\u00b03 et n\u00b04 <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">\u00e9nonc\u00e9s dans le PADD (Plan d\u2019Am\u00e9nagement et de D\u00e9veloppement Durable) de ce SCOT<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">.<\/span><\/span><\/span><\/b><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000; font-family: symbol;\"><strong><span lang=\"fr-FR\" style=\"font-size: 14pt;\">\u2192<\/span><\/strong> <\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i><b>Objectif n\u00b01<\/b><\/i><\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i> : Pr\u00e9server les valeurs fondamentales qui font l\u2019image du territoire\u2026 <\/i><\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i><b>l\u2019agriculture<\/b><\/i><\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i>, les espaces naturels, le paysage\u2026 <\/i><\/span><\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Cet objectif se traduit dans le Document d\u2019Objectifs et d\u2019Orientation (DOO) par la prescription suivante (chapitre 2.1.1, page 17)\u00a0: <\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i>\u00ab\u00a0Au sein des <\/i><\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i><u>espaces agricoles \u00e0 forte valeur et \u00e0 tr\u00e8s forte valeur<\/u><\/i><\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i> : Le principe d\u2019\u00e9vitement doit \u00eatre mis en \u0153uvre en priorit\u00e9 : <\/i><\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">\u00ab\u00a0<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i>espace agricole <\/i><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i><u>ordinaire<\/u><\/i><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><u>\u00a0<\/u><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">\u00bb, <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">en s\u2019appuyant sur une <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">carte du \u00ab\u00a0Potentiel Agronomique sols \u00e0 vocation agricole\u00a0\u00bb et <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">une <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">carte de la \u00ab\u00a0Trame agricole\u00a0\u00bb\u00a0, <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><u><b>sans que soient mentionn\u00e9s les \u00e9l\u00e9ments scientifiques ni les documents sur lesquels se sont appuy\u00e9s ces cartes.<\/b><\/u><\/span><\/span><\/span><b> <\/b><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">Or, plusieurs documents et cartes, <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><b>non mentionn\u00e9s dans le SCOT<\/b><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">, font appara\u00eetre clairement que le secteur des Fontanelles \u00e0 Saint-Cl\u00e9ment-de-Rivi\u00e8re constitue un espace agricole \u00e0 potentiel agronomique <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><b>fort \u00e0 tr\u00e8s fort\u00a0<\/b><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">: <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">nous mentionnons<\/span><\/span><\/span> <span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">d<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">es cartes officielles <\/span><\/span><\/span><a class=\"western\" href=\"http:\/\/carto.geo-ide.application.developpement-durable.gouv.fr\/360\/c_draaflr_cartes.map#\">de la DRAAF<\/a><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span principalement fort \u00e0 tr\u00e8s fort (sur environ 80% de la zone).\u00a0<\/i><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">\u00bb, <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">ainsi qu\u2019<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">une \u00e9tude g\u00e9o-p\u00e9dologique de la zone r\u00e9alis\u00e9e par un ing\u00e9nieur agronome de l\u2019INRA, co-auteur de lang=\"fr-FR\"><i>Nous avons l\u00e0, en excluant les collines bois\u00e9es, des sols de qualit\u00e9 qui peuvent porter toutes les cultures traditionnelles (annuelles ou p\u00e9rennes) ou mara\u00eech\u00e8res. <\/i><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i><b>Si l\u2019on fait r\u00e9f\u00e9rence aux autres sols m\u00e9diterran\u00e9ens, ceux-ci peuvent supporter la comparaison haut la main<\/b><\/i><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i>, notamment dans la r\u00e9serve en eau (RU) \u00e9lev\u00e9e \u00e0 tr\u00e8s \u00e9lev\u00e9e, provenant d\u2019une grande profondeur, mais aussi et surtout d\u2019une texture riche en argile qui est gage de r\u00e9tention hydrique et de r\u00e9serves fertilisantes\u00a0\u00bb.<\/i><\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">Le 4 juin 2019, l<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">ors d\u2019une rencontre avec MM. Barbe, pr\u00e9sident de la Communaut\u00e9 de <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">C<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">ommunes, et Al Mallak, vice-pr\u00e9sident charg\u00e9 de l\u2019\u00e9laboration du SCOT, nous avons demand\u00e9 que nous <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">soient<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"> transmis les documents <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">scientifiquement attest\u00e9s<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"> qui justifieraient le classement de la zone en \u00ab\u00a0espace agricole ordinaire\u00a0\u00bb. Ceux-ci ne nous ont jamais \u00e9t\u00e9 fournis, et, avec l\u2019as<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">s<\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">ociation France Nature Environnement, nous avons saisi la CADA (Commission d\u2019Acc\u00e8s aux Documents Administratifs). <\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">Sans retour \u00e0 ce jour.<\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i><b><strong>\u2192<\/strong> Objectif n\u00b03<\/b><\/i><\/span><\/span><\/span><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i> : S\u2019appuyer sur les potentialit\u00e9s du territoire pour asseoir le d\u00e9veloppement <\/i><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><i>\u00e9conomique. <\/i><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">Le document de Diagnostic <\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">Socio-\u00e9conomique<\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"> pointe \u00e0 plusieurs reprises le d\u00e9s\u00e9quilibre qui existe entre les territoires situ\u00e9s au Sud (zone p\u00e9ri-urbaine de Montpellier) et les autres\u00a0: <\/span><\/span><span style=\"color: #000000;\">\u00ab\u00a0<\/span><span style=\"color: #000000;\"><i><b>Le Secteur sud du territoire concentre <\/b><\/i><\/span><span style=\"color: #000000;\"><i><u><b>94 % de l\u2019offre en grandes et moyennes surfaces<\/b><\/u><\/i><\/span><span style=\"color: #000000;\"><i> (commerces sup\u00e9rieurs \u00e0 300 m\u00b2 de surface de vente), et le Secteur Est les 6% restant\u00a0\u00bb <\/i><\/span><span style=\"color: #000000;\"><b>alors qu<\/b><\/span><span style=\"color: #000000;\"><b>e le Secteur sud<\/b><\/span><span style=\"color: #000000;\"><b> n\u2019accueille que 55\u00a0% des habitants\u00a0.<\/b><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Le document d\u2019\u00c9valuation Environnementale, expliquant les choix retenus lors de l\u2019\u00e9laboration du <\/span><\/span><span style=\"color: #000080;\"><span lang=\"zxx\"><u><a class=\"western\" href=\"http:\/\/www.scot-picsaintloup.fr\/index.php?option=com_phocadownload&amp;view=category&amp;download=510:scot-padd&amp;id=6:dossiers-scot&amp;Itemid=44\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">PADD<\/span><\/span><\/a><\/u><\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"> et du DOO, confirme que ce diagnostic\u00a0:<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">\u00ab\u00a0<\/span><span style=\"color: #000000;\"><i>a mis en \u00e9vidence un manque de coh\u00e9rence dans la structuration de l\u2019armature urbaine du territoire g\u00e9n\u00e9rant un d\u00e9veloppement d\u00e9s\u00e9quilibr\u00e9 \u00bb. <\/i><\/span><span style=\"color: #000000;\">Or, \u00ab\u00a0<\/span><span style=\"color: #000000;\"><i>l<\/i><\/span><span style=\"color: #000000;\"><i><b>a structuration du territoire est un \u00e9l\u00e9ment central dans la mise en coh\u00e9rence de l\u2019am\u00e9nagement du territoire, de son d\u00e9veloppement urbain et \u00e9conomique, en \u00e9quilibre avec les autres enjeux du territoire<\/b><\/i><\/span><b> <\/b><span style=\"color: #000000;\">\u00bb. <\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">En cons\u00e9quence de quoi, <\/span><\/span><span style=\"color: #000000;\">\u00ab\u00a0<\/span><span style=\"color: #000000;\"><i> S\u2019appuyer sur les communes du Sud \u2013 qui sont les plus attractives \u2013 aurait conduit \u00e0 <\/i><\/span><span style=\"color: #000000;\"><i>encourager et faire prosp\u00e9rer le ph\u00e9nom\u00e8ne de pression fonci\u00e8re\u00a0<\/i><\/span><span style=\"color: #000000;\">\u00bb.<\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">Or, que pr\u00e9voit le DOO\u00a0? Ce document<\/span><\/span><span style=\"color: #000000;\"> \u00ab\u00a0<\/span><span style=\"color: #000000;\"><i>\u00e9tablit un objectif de <\/i><\/span><span style=\"color: #000000;\"><i><b>60Ha d\u2019extension fonci\u00e8re maximum<\/b><\/i><\/span><span style=\"color: #000000;\"><i>, permettant un petit d\u00e9veloppement \u00e0 horizon 2030.<\/i><\/span><span style=\"color: #000000;\">\u00a0\u00bb <\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">Mais, sur les 60ha d&rsquo;extension fonci\u00e8re maximum d\u00e9volus aux activit\u00e9s \u00e9conomiques, <\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"><b>48ha sont attribu\u00e9s aux seules communes de Saint-Cl\u00e9ment-de-Rivi\u00e8re et Saint-G\u00e9ly-du-Fesc<\/b><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">. Ce qui ne laisse que 12ha, maximum, pour les extensions fonci\u00e8res des p\u00f4les Est et Ouest. Le cas de Saint-Cl\u00e9ment-de-Rivi\u00e8re est particuli\u00e8rement frappant : cette commune b\u00e9n\u00e9ficie d\u00e9j\u00e0 d\u2019un important centre commercial, Trifontaine, qui est <\/span><\/span><\/span><\/span><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">\u00ab\u00a0<\/span><span style=\"color: #000000;\"><i><b>la zone commerciale la plus importante du territoire\u00a0\u00bb. <\/b><\/i><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">Avec le SIP Oxylane, elle renforce encore son <\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">h\u00e9g\u00e9monie<\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"> commercial<\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">e\u00a0: les 24ha qui seraient consomm\u00e9s par ce SIP r\u00e9duisent consid\u00e9rablement les possibilit\u00e9s sur le reste du territoire\u00a0: <\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">\u00e0 <\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">lui seul, le SIP consommerait <\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"><b>plus du tiers<\/b><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"> des 60ha maximum allou\u00e9s \u00e0 ces extensions\/cr\u00e9ations sur l\u2019ensemble du territoire (<\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"><b>soit 71\u00a0% des 38,2 ha suppl\u00e9mentaires mobilisables pour le foncier commercial).<\/b><\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">Ainsi,<\/span><b> <\/b><span style=\"color: #000000;\"><b>l<\/b><\/span><span style=\"color: #000000;\"><b>es prescriptions du Document d\u2019Orientations et d\u2019Objectifs permettant le maintien du SIP \u00ab\u00a0Oxylane\u00a0\u00bb sont en contradiction avec l\u2019objectif n\u00b03 du PADD (Plan d\u2019Am\u00e9nagement et de D\u00e9veloppement Durable).<\/b><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000;\"><strong><span lang=\"fr-FR\">\u2192 <\/span><\/strong><i><b><\/b><\/i><\/span><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\"><i><b>Objectif n\u00b04<\/b><\/i><\/span><span style=\"color: #000000;\"><i> : Organiser la mobilit\u00e9 pour limiter les d\u00e9placements automobiles et faciliter le report modal <\/i><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">S<\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">elon le style=\"font-size: medium;\"><span lang=\"fr-FR\">\u00ab\u00a0<\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\"><i>l\u2019identification des localisations pr\u00e9f\u00e9rentielles pour le d\u00e9veloppement commercial r\u00e9pond \u00e0 plusieurs objectifs\u00a0\u00bb <\/i><\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">propres \u00e0 pr\u00e9ciser l\u2019objectif g\u00e9n\u00e9ral de limitation des d\u00e9placements automobiles, <\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">et notamment<\/span><\/span><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span lang=\"fr-FR\">\u00a0: <\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Calibri, sans-serif;\"><span desservis par les diff\u00e9rents modes de transport, [\u2026]\u00a0 Le Projet d\u2019Am\u00e9nagement Commercial Durable affirme cet objectif de polarisation de l\u2019offre commerciale dans des localisations pr\u00e9f\u00e9rentielles qui seront identifi\u00e9es dans le DOO afin\u00a0\u00a0 <\/i><\/span><\/span><\/span><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><i><span style=\"color: #000000;\">[\u2026]<\/span><strong><span style=\"color: #000000;\"> d<\/span><\/strong><span style=\"color: #000000;\"><b>e r\u00e9duire les d\u00e9placements motoris\u00e9s li\u00e9s aux achats<\/b><\/span><span style=\"color: #000000;\">,\u00a0\u00bb<\/span><\/i><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">Dans le DOO, les prescriptions cens\u00e9es mettre en \u0153uvre ces objectifs sont peu nombreuses. Elles pr\u00e9cisent <\/span><\/span><span style=\"color: #000000;\">\u00ab\u00a0<\/span><i><span style=\"color: #000000;\">les conditions <\/span><span style=\"color: #000000;\">permettant de favoriser le d\u00e9veloppement de l&rsquo;urbanisation prioritaire dans les secteurs desservis par les transports collectifs\u00a0\u00bb <\/span><\/i><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">par exemple\u00a0:<\/span><\/span> <\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Calibri, sans-serif;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">\u00ab\u00a0<\/span><i><span style=\"color: #000000;\">Les \u00e9quipements d\u2019int\u00e9r\u00eat supra-communal devront \u00eatre implant\u00e9s \u00e0 proximit\u00e9 des axes structurants du territoire du SCoT, <\/span><span style=\"color: #000000;\"><b>notamment ceux supports de transports en commun et de dessertes pour les modes actifs<\/b><\/span><span style=\"color: #000000;\">.\u00a0\u00bb . <\/span><\/i><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">Et pourtant, <\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">l<\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">e SIP \u00ab\u00a0Oxylane\u00a0\u00ab\u00a0, <\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">bien que <\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">consid\u00e9r\u00e9 comme un \u00e9quipement d\u2019int\u00e9r\u00eat supra-communal, ne respecte pas ces conditions\u00a0: il ne b\u00e9n\u00e9ficie d\u2019aucune desserte satisfaisante en transports en commun (arr\u00eat \u00ab\u00a0Campus de Bissy\u00a0: 5 \u00e0 7 passages par jour de la ligne 614 du r\u00e9seau \u00ab\u00a0H\u00e9rault Transport\u00a0\u00bb). Il n\u2019est pas non plus connect\u00e9 au r\u00e9seau cyclable existant\u00a0: la RD 986 (assurant la liaison avec Saint-Gely-du-Fesc) est d\u00e9pourvue de tout \u00e9quipement cyclable, et sa configuration en 2 fois 2 voies la rend totalement inadapt\u00e9e \u00e0 la circulation cycliste, la RD 127 E3 (assurant la liaison avec le reste de la commune de Saint-Cl\u00e9ment-de-Rivi\u00e8re) n\u2019est \u00e9quip\u00e9e de bandes lat\u00e9rales non prot\u00e9g\u00e9es que sur une petite partie de son parcours. Les projets d\u2019am\u00e9lioration ne sont pas pr\u00e9cis\u00e9s dans le SCOT, ils sont d\u2019ailleurs tr\u00e8s incertains\u00a0: les transports en commun <\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">comme<\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"> le r\u00e9seau cyclable sont, sur le territoire du Grand Pic Saint-Loup, de la comp\u00e9tence <\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">respective de la r\u00e9gion Occitanie et <\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">du D\u00e9partement de l\u2019H\u00e9rault. Ces projets seraient<\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"> donc conditionn\u00e9s \u00e0 l\u2019aboutissement de n\u00e9gociations entre la CCGPSL <\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\">et la R\u00e9gion ou<\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"> le D\u00e9partement. <\/span><\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>La localisation du SIP \u00ab\u00a0Oxylane\u00a0\u00bb est donc en contradiction totale avec ces objectifs et ces prescriptions. <\/b><\/span><\/span><\/span><\/p>\n<p align=\"center\"><span style=\"color: #ff0000; font-size: 14pt;\"><span style=\"font-family: Times New Roman, serif;\"><b>O\u00f9 en est la proc\u00e9dure\u00a0?<\/b><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Depuis le d\u00e9p\u00f4t de notre requ\u00eate, le 11 juin 2019, la Communaut\u00e9 de communes n\u2019a encore fourni aucun m\u00e9moire en d\u00e9fense. Son avocat vient d\u2019\u00eatre mis en demeure de le faire, le 6 novembre, dans un d\u00e9lai de 30 jours.<\/span><\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>Nous attendons avec s\u00e9r\u00e9nit\u00e9 les arguments de la Communaut\u00e9 de Communes\u00a0! <\/b><\/span><\/span><\/span><\/p>\n<p align=\"center\"><span style=\"color: #ff0000; font-size: 14pt;\"><span style=\"font-family: Times New Roman, serif;\"><b>Quelles seront les cons\u00e9quences\u00a0?<\/b><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"left\"><span style=\"color: #ff0000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>Si le Tribunal Administratif \u2013 voire l<\/b><b>a<\/b><b> Cour <\/b><b>Administrative<\/b><b> d\u2019Appel le cas <\/b><b>\u00e9ch\u00e9ant<\/b><b> \u2013 nous donne raison<\/b>, la d\u00e9lib\u00e9ration d\u2019approbation du SCOT sera partiellement annul\u00e9e. Cette annulation obligerait la Communaut\u00e9 de Communes \u00e0 r\u00e9viser le SCOT, en retirant le projet Oxylane de ce document. <b>De plus, <\/b><b>c<\/b><b>ette annulation partielle<\/b><b> <\/b><b>rendrait justice <\/b><b>aux centaines de personnes qui se sont exprim\u00e9es contre le projet Oxylane lors de l\u2019enqu\u00eate publique sur le SCOT, <\/b><b>en pointant ses incoh\u00e9rences, <\/b><b>et <\/b><b>dont l\u2019avis n\u2019a pas \u00e9t\u00e9 entendu.<\/b><\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\" align=\"left\"><span style=\"color: #ff0000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>Est-ce que cela serait suffisant pour emp\u00eacher le projet de se r\u00e9aliser<\/b>, si les autres recours (permis d\u2019am\u00e9nager, autorisation pr\u00e9fectorale \u00ab\u00a0loi sur l\u2019eau\u00a0\u00bb) n\u2019aboutissaient pas\u00a0?
